Learn the Bankruptcy Basics:
1) Who are the players?
a. We will discuss the interplay between the court, the trustee, the debtor, the creditors and everyone’s respective attorneys.
2) What is the process?
a. We will review a basic intake process for a simple chapter 7 bankruptcy.
b. A short review of the various schedules filed in every bankruptcy.
c. A brief outline of the chronological process, including the meeting with the trustee and creditors.
3) What is the automatic stay?
a. We will discuss the importance of the stay in protecting the debtor and debtor’s assets.
b. Plus, the consequences of a creditor ignoring the automatic stay.
4) What is the discharge?
a. We will discuss breadth of the discharge and exceptions to discharge.
